Project overview and role:
USAID and the Palladium-led Health Policy Plus (HP+) project will summarize opportunities for development partners such as USAID to play a key role in catalyzing growth of local, innovative companies in India that expand access to family planning (FP) commodities. As a basis for demonstrating these opportunities, HP+ will conduct a desk review to identify and explore the legal, tax, regulatory, and investment climate of the importation, distribution, wholesale, local manufacturing, and e-retail of FP commodities in one Ind ian state. Particularly, this regulatory assessment should identify any barriers that may inhibit scale or innovation in India’s FP market, or hinder the potential for either internal or external investments which can enable market growth.
HP+ is seeking a qualified legal and regulatory consultant based in India to serve as a local lead for this desk review and exploration of the FP regulatory environment in India. The consultant will work with the HP+ team remotely to first create a policy framework for assessing and organizing the relevant legal, regulatory, and financial policies, and will then use the framework to conduct the desk review and collect all policy documents at both the national and subnational level.

The desk review will provide more information to understand:
Legal and regulatory processes surrounding the importation, distribution, wholesale, local manufacturing, and e-retail, of FP commodities for private (non-state) actors in one state (A ssam TBC), excluding brick and mortal retail outlets

State specific legal barriers and/or market shortcomings which prevent the private sector from either entering, participating in or growing the FP market.

To follow up on barriers uncovered in the desk review, HP+ will work with the hired consultant to conduct a limited number of key informant interviews with relevant health associations, private health care organizations, and family planning companies to identify specific areas where operational and regulatory barriers lie as well as other factors which hinder the growth of the FP market in Assam (TBC). While the consultant is responsible for providing a draft of the interview tools, clear interview notes and summary materials, HP+ will provide support on the tools and the prioritization of interviews for the consultant. This information will help provide more information to understand the enabling environment that influences supply-side dynamics and identify the barriers impeding private sector FP market growth and innovation.

Scope of Work:
The consultant will be engaged for up to a total of 20 nonconsecutive days from December 2020 – January 2021. The consultant’s work will focus on the three tasks identified below, although additional minor activities may be required as the activity evolves.

Create a policy framework to analyze the legal, regulatory, and financial environment and policies surrounding private FP commodity importation, distribution, wholesale, local manufacturing, e-retail, and procurement processes in one Indian State

Deliverable(s):
* Submit a policy framework with the support of the HP+ team
* Use the policy framework to conduct the desk review of the topics. Scope for barriers and/or market shortcomings which prevent the private sector (as detailed above) from either entering, participating, or growing the FP commodity market at both the federal and state level. A lso scan for existing private investors in the FP commodity market (or women’s health as applicable)
* Completed policy framework filled with relevant policies that inhibit market growth, innovation, and entry.
* Summary of desk review findings in a report; include a separate table of relevant private investment actors and current investment scopes/size
* Conduct <10 key informant interviews remotely with health associations, private health care organizations, or family planning companies to further identify or pinpoint specific regulatory barriers that may not be well documented.
* Provide organized interview notes
* Synthesize interview notes and analyze findings into an internal report, identifying impactful regulatory barriers that were mentioned. port

REQUIRED QUALIFICATIONS:
* Master’s degree in a p ublic health, business administration, or other related discipline is preferred
* Familiarity with the legal and regulatory environment surrounding the FP commercial market in India is preferred
* Experience conducting key informant interviews and desk research
* Experience with policy analysis
* Strong business acumen
* Experience in business finance, investment or private equity a plus
* Fluency in English and strong writing, communication, and reporting skills
* Prior work with USAID, or other international development partners desirable
* Excellent interpersonal and communication skills
* Experience with PowerPoint, Word, and Excel
* Ability to work within tight deadlines
* Flexibility, adaptability, and resourcefulness
